1. Acceptance of Terms

By accessing or using Artistle ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using Artistle, you represent and warrant that:

• You are 18 years of age or older;
• You have the legal capacity to enter into a binding agreement;
• You will comply with these Terms at all times.

If you do not meet these requirements, you must not use the Service.

3. Account Registration

3.1 Creating an Account

Certain features require you to register an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

3.3 One Account Per Person

You may not create multiple accounts or use someone else's account without permission.

4. The Service

Artistle is a free, browser-based music-artist guessing game. We offer:

• Daily challenges — one new puzzle per day for all players
• Custom games — player-created games with custom filters
• Challenge a Friend — shareable puzzle links you can send to others
• Profiles — username, avatar, stats, streaks, and medals

The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability.

5. Advertising

The Service displays third-party advertisements. By using the Service, you acknowledge that:

• Ad partners may use cookies and similar tracking technologies to serve relevant ads;
• We do not control the content of third-party ads;
• You can manage ad personalisation through your browser settings or your ad partner's opt-out tools (e.g. Google Ads Settings).

We are not responsible for the content, accuracy, or practices of any advertiser.

6. User Content

6.1 What Is User Content

"User Content" means any content you submit to the Service, including your username, profile avatar, and any game configurations you create.

6.2 Your Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to submit your User Content;
• Your User Content does not violate any third-party rights or applicable law;
• Your User Content is not offensive, harmful, or otherwise in violation of these Terms.

6.3 Licence to Us

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and use your User Content solely to operate and improve the Service. This licence ends when you delete the content or your account, except where copies remain in routine backups.

6.4 Content Standards

User Content must not include material that is:

• Sexually explicit, obscene, or pornographic;
• Hateful, threatening, or harassing toward any individual or group;
• Infringing on any third party's intellectual property rights;
• Impersonating another person or entity.

We reserve the right to remove any User Content that violates these standards.

7. Prohibited Conduct

You agree not to:

• Cheat or manipulate game scores, streaks, or standings through any means including exploiting bugs, automated scripts, or unauthorised clients;
• Scrape, crawl, or automate access to the Service without our express written permission;
• Reverse-engineer or attempt to extract the source code, algorithms, or data structures of the Service;
• Interfere with the Service's infrastructure, servers, or network connections;
• Create or use bots or other automated means to interact with the Service;
• Harass, threaten, or abuse other users;
• Upload an avatar or username containing offensive, hateful, or illegal content;
• Circumvent any access controls or security measures;
• Use the Service for any unlawful purpose or in violation of applicable law.

8. Account Suspension and Termination

8.1 Our Rights

We may suspend or permanently terminate your account, without prior notice, if we determine in our sole discretion that you have:

• Cheated or manipulated game data or rankings;
• Uploaded a username or avatar containing harassing, abusive, or otherwise objectionable content;
• Engaged in scraping, botting, or automated access;
• Violated any provision of these Terms.

8.2 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

8.3 Your Right to Leave

You may delete your account at any time by contacting us at [email protected]. We will process your request within 30 days.

9. Intellectual Property

9.1 Our Property

The Service, including its code, design, gameplay mechanics, logo, and original content, is owned by the operator and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our express written permission.

9.2 Artist Data

Artist names, discographies, and related factual data used in the game are sourced from publicly available databases (Spotify, MusicBrainz, Kworb). Artist names are factual information and are not claimed as our intellectual property.

9.3 Feedback

If you submit ideas, suggestions, or feedback about the Service, you grant us the right to use that feedback without any obligation to compensate you.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure;
• Any defects will be corrected;
• The Service is free of viruses or other harmful components.

Nothing in this section limits any warranty rights you may have under mandatory applicable consumer protection law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Service.

In no event shall our total liability to you exceed EUR 100, regardless of the legal theory.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory applicable law.

12. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party services. Accessing them is at your own risk.

13. Changes to These Terms

We may update these Terms from time to time. We will indicate the revised date at the top of this page. Your continued use of the Service after changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, stop using the Service.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Czech Republic.

If you are a consumer resident in the European Union, you may also be entitled to bring claims before the courts of your country of residence under mandatory EU consumer protection law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
